These terms cover the PANOpeak website at panopeak.app, the waitlist, and the PANOpeak product at app.panopeak.app: the Buy Box repricing service itself. They replace the earlier version, which covered the waitlist only and predated the product going live. By using this site, joining the waitlist, or creating a PANOpeak account, you agree to the terms below.
1. What these terms cover
These terms apply to the marketing website, the waitlist, and every PANOpeak account and subscription. If your workspace has agreed a separate signed order form or enterprise agreement with us, that document's specific terms take priority over this page wherever the two conflict.
2. The waitlist and the founding-member offer
You can join the waitlist by giving us your email and confirming it. Joining is free and puts you in line for early access. Founding members from the waitlist are offered 50% off any plan for their first 6 months after starting a subscription. We grant access in the order people joined, and we may adjust our timing as building the product requires, but we will not quietly change what the founding-member offer means once you have joined.
3. Your account, trial, and subscription
Creating an account starts a free trial. Your subscription, plan limits, and price are shown at signup and in Settings → Billing; we bill through Stripe and never see or store your card details ourselves. You are responsible for keeping your account credentials secure and for everyone who has a login under your workspace.
If a payment fails, we retry it and notify you before taking any action. If payment is not resolved within a short grace period after the final retry, we pause repricing on your account until it is; we do not delete your data for a payment problem alone.
PANOpeak is a business tool and is not offered to, marketed to, or designed for children. To create an account you must be at least 18 years old, acting for a business, and authorised to enter these terms on that business's behalf. We do not knowingly collect personal data from children; if you believe a child has given us data, email founder@panopeak.app and we will delete it.
4. Using PANOpeak: what the product does, and does not, guarantee
PANOpeak repricing acts within the floor and ceiling you configure for each listing, on the marketplaces you connect. Winning the Buy Box depends on the marketplace's own algorithm, which we do not control and which can change without notice to us; we do not guarantee any particular outcome, ranking, or win rate. PANOpeak will never intentionally price a listing below the floor you set.
Features, plan limits, and specifications may change as the product develops. Where a change would narrow what your current plan is entitled to, we widen or grandfather existing customers rather than reduce what you already have; we do not silently take away capacity you are paying for.
Your plan's limits work differently depending on what they protect. Your SKU limit is a metered threshold, not a cut-off: exceeding it adds a small per-SKU overage to your bill rather than switching anything off, exactly as described on our pricing page. Your channel limit and your plan's data-retention window are hard limits: connecting a marketplace beyond your plan's channel count is refused, and operational history, listings, price history, and competitor snapshots, is only retained and readable for the window your plan includes. Requests to our API are rate-limited per plan to keep the service available for every customer.
Two figures describe an aim rather than a promise. The repricing cadence shown for your plan is a target we build the product to hit, not a guaranteed floor: the cadence actually achieved on each marketplace also depends on that marketplace's own rate limits and the size of your catalogue, and can be slower during a busy period. Your plan's daily API-call allowance bounds only the repricing cycles PANOpeak runs on a schedule; a price change triggered by a marketplace telling us a competitor has moved is not counted against it, because by then the market has already changed and the published price is already wrong, so a busy account can see more repricing activity in a day than the advertised allowance alone would suggest. Any other usage figures shown in your dashboard are informational only and are not enforced as limits.
5. Marketplace connections and your responsibilities
You are responsible for holding valid seller accounts on the marketplaces you connect, for the accuracy of the credentials you provide, and for complying with each marketplace's own terms of service, including any restrictions that marketplace places on automated or algorithmic repricing. PANOpeak is an independent tool and is not affiliated with, sponsored by, or endorsed by Bol.com, Amazon, Kaufland, eMAG, MediaMarkt, Decathlon or TikTok Shop; those names and logos belong to their respective owners and are used here only to describe what PANOpeak connects to.
6. Acceptable use
Please use the site and the product normally. Do not scrape the site at abusive rates, attempt to bypass rate limits or authentication, submit false or misleading information, use PANOpeak to reprice listings you are not authorised to manage, or attempt to probe, disrupt or break the site, the product, or the services behind it. We may suspend access that threatens the security or availability of the service or other customers.
7. Data protection and the DPA
Where PANOpeak processes personal data on your behalf as a data processor, chiefly, data reachable through the marketplace connections you configure, our Data Processing Agreement is incorporated into these terms by reference and governs that processing. You accept the version in force from your workspace's Settings page before your first marketplace connection; see our Privacy Policy for the rest.
8. Intellectual property and marketplace names
The content, design, code and the PANOpeak name and mountain mark on this site and in the product belong to us. You may not copy or reuse them except as normal use of the service requires. Your catalogue and pricing data remain yours; using PANOpeak does not transfer any rights in it to us beyond what is needed to provide the service.
9. No warranties, and limitation of liability
The service is provided on an "as is" and "as available" basis, without warranty that it will be uninterrupted, error-free, or achieve any particular pricing or Buy Box outcome. We do our best to keep the site and the product accurate and available, but we make no warranty beyond what applies by law.
To the fullest extent permitted by Dutch law, PANOpeak is not liable for indirect or consequential loss, for pricing decisions produced by strategy settings you configured, or for any action a marketplace takes against your seller account as a result of your use of that marketplace's own API or platform. Nothing in these terms excludes liability that cannot be excluded under law.
10. Term, suspension and cancellation
You may cancel your subscription, or request deletion of your workspace entirely, at any time from Settings. A deletion request has a 30-day window in which you can change your mind before it becomes permanent, described in the Privacy Policy. We may suspend or terminate an account for breach of these terms, for non-payment beyond the grace period described in Section 3, or where required by law.
11. Governing law and disputes
These terms are governed by the laws of the Netherlands. Any dispute arising from them or from your use of the site or the product will be submitted to the competent court in the Netherlands [venue, t.b.d.].
